The two suits — the first settled in 2009, the second ongoing — involve more than 1,000 retired or still- employed Louisville firefighters whose overtime pay stretching back to 1985 was found by the Kentucky Labor Cabinet and the courts to have been miscalculated by the City of Louisville. Te Kurtsinger (lead plaintiff) settle- ment ultimately cost the city close to $50 million, payable to 834 former or current firefighters, many of whom have joined another suit against the law firms that arranged the settlement. Te payout total for the ongoing Hasken suit, which includes 124 retiree plaintiffs who chose not to accept the Kurtsinger settlement as well as a growing number of the 94 "left-behinds" — those entitled retirees who, for whatever reason, didn't take part previously in either suit against the city — could reach as much as $35.5 million, according to lead Hasken attorney Ann Oldfather.
