When two gay couples challenged Kentucky's same-sex marriage ban, you may have thought Gov. Steve Beshear's lawyers had arrived fresh from a gig at Te Onion. Te state's legal ammuni- tion? Allowing gay couples the right to marry would harm Kentucky's birth rate and thus damage our economy. Seriously. Baby-making as a defense. In a ruling issued last month, federal Judge John Heyburn II spanked (to use proper legal phrasing) Beshear's argument to bits. It's the most delightfully snarky legal docu- ment we've ever read. First, Heyburn categorizes the state's argu- ment as "disingenuous." Now to the good stuf: "Tese arguments are not those of seri- ous people. Tough it seems unnecessary to explain, here are the reasons why…. (Te) Court fails to see, and the Defendant never explains, how the exclusion of same-sex couples from marriage has any efect whatsoever on procreation among…heterosexual couples who choose to get married, the number who choose to have children, or the number of children they have. "Te state's attempts to connect the exclu- sion of same-sex couples from marriage to its interest in economic stability and in 'ensuring humanity's continued existence' are at best il- logical and even bewildering." Heyburn's decision marked the 23rd pro- marriage ruling since the Supreme Court's deci- sion last summer declaring same-sex marriage bans unconstitutional. Beshear may appeal.
