Brian Borellis brian borellis, attorney at law 802 Stone Creek Pkwy., Suite 8 • Louisville, KY • 40223 • (502) 425-5297 • bblex001@aol.com Mr. Borellis continues to successfully represent clients who need legal representation to lawfully protect assets for a spouse or a disabled child who requires long term care whether in a nursing home or otherwise. When faced with the diffcult emotional burden of placing a loved one in a nursing home, the bureaucratic and fnancial challenges often become overwhelming. With more than twenty-fve years of experience in estate and asset protection planning, through the combination of effective advocacy and depth of technical skills, Mr. Borellis is well-equipped to handle the wide spectrum of situations which his clients face. In order to take advantage of the law, one must be familiar with complex regulations and be able to set up legal structures which may involve trusts and certain special annuities. "Clients who have attempted to handle Medicaid applications themselves very quickly realize that the process makes an IRS tax audit seem tame by comparison. It comes as a great relief for them to discover that we can provide this service, and they don't have to go broke to qualify for Medicaid long term care benefts. The typical client is one who suddenly comes face to face with the shocking realization that long term nursing home costs average between $7,000 and $8,000 per month in the Louisville area. Add to that the fact that unless one has a long term care insurance policy, the expense will not be covered by traditional health insurance or Medicare, except for possibly a portion of up to 100 days, and it is easy to see that professional guidance is necessary and will literally pay for itself in savings." As health care costs continue to become the focus of government regulation, more than ever it is important for clients to have an experienced and steady hand on the legal controls. With his solid background in this area, Borellis handles each case individually. Planning and advocacy is achieved through personalized documents that are his own drafting and work product, rather than fll in the blank forms or documents provided by on-line document producing companies. "I never have felt comfortable with cookie cutter type canned legal forms prepared by a business in New York that sells pre-packaged trusts often 50-60 pages long where the client's name is just a matter of a click and replace on a computer. What we do in this area is handle our client's most personal and critically important wishes and strategies. To do that effectively requires nothing more than a simple and direct plan, and carefully working with the family: Nothing more; nothing less." Mr. Borellis has been practicing Elder Law since 1988, having a solid background as an estate planning attorney for personal estates and trusts. This is his tenth successive peer award among Louisville's Best Lawyers. He continues to write and lecture extensively on the subject of Elder Law. His "Medicaid Eligibility Planning" publication of the University of Kentucky College of Law is widely used by law frms and libraries throughout the state of Kentucky. In 2011, 2012 and 2013 he was listed in US News & World Report Magazine and the Wall Street Journal as among the Best Lawyers in America. He is a member of the National Association of Elder Law Attorneys; the National Care Planning Council; the American, Kentucky and Louisville Bar Associations where he is an active member in the Elder Law, Probate and Estate sections. He is also a member of the Legislative Committee of the Kentucky Bar Association Probate and Trust Section where his drafting work was the basis for the Kentucky Special Needs Trust statute enacted into law by the Kentucky General Assembly in 2012.
