While still handling cases for single individuals, mr. Borellis has also been focusing more on assisting married couples. This is especially important where one of the spouses requires long term nursing care and the other is living at home or in assisted living. ���since 1988 the law has allowed couples to protect most of the assets and a large amount of income for the non-institutionalized spouse rather than have to spend down by paying for nursing home expenses which average about $7,000 per month in Louisville.��� in order to take advantage of the law, one must be familiar with complex regulations and be able to set up legal structures which may involve trusts and certain special annuities. ���Clients are universally greatly relieved to discover that they don���t have to go broke to qualify for medicaid long term care bene��ts.��� also, since last years��� Best Lawyers issue, in July 2012 the Kentucky legislature has enacted the Kentucky special needs Trust statute drafted by mr. Borellis. This important piece of legislation has now opened a clear pathway for disabled or special needs individuals to protect assets in a special needs Trust and qualify for medicaid assistance. The new statute expands the list of individuals who may set up the trust plan: under the old law, the only group of individuals who could create a special needs Trusts were parents, grandparents, and the legal guardian of the disabled person. Under the new law, a spouse, sibling, or niece or nephew cannow��leasimplepetitionwiththelocalcourttocreatethe trust for the person with disability. already this new law is of great bene��ttothefamiliesofthosewithdisabilityandtheiradvisorsto qualify for important federal and state cash assistance and medical bene��ts. mr.
